Who you are contracting with
Yafta is operated by Mohamed Abdelmaksoud, a sole proprietorship registered in Egypt under commercial register number 273292 and tax registration number 769-584-012. Yafta is a trading name and not a separate company.
In these terms, "we" and "us" mean that business, and "you" means the business using Yafta. You can reach us at mohamed@abdelmaksoud.dev or through our contact page.
By creating an account or using Yafta, you accept these terms.
What Yafta does
Yafta produces social media images and captions from photographs of your own dishes. You set up your restaurant once, with your brand, your branches, your menu and a photograph of each dish, and Yafta produces posts from that.
Every image is based on a photograph you supplied. Yafta does not generate food from a written description.
You approve and you publish
Yafta has no connection to your social media accounts and cannot publish on your behalf. It does not post to Facebook, Instagram or any other platform.
Every image is a draft until you approve it. You then download it and publish it from your own accounts. Marking a post as published within Yafta is a record for your own use; we cannot verify it and attach no other meaning to it.
Because you approve and publish every image, you are the advertiser. You are responsible for confirming that prices, offers, claims and any other information on a post are correct before you publish it.
Credits and payment
Yafta is sold in credits. A standard post costs one credit. Some posts cost more, and the cost is shown before you confirm:
- an offer post costs one credit for each dish it features;
- an event poster costs one credit, plus one credit for each photograph included in it.
Generating a new look for your posts also costs one credit. The first look in each format is free.
Re-generating the image on a post you have already paid for is free, up to three times per post. Caption and branding changes are free and unlimited.
Credits are granted monthly with your plan and expire thirty days after they are granted. Spending draws on the credits that expire soonest. Unused credits do not carry over.
Refunds and cancellation are governed by our refund policy, which forms part of these terms.
For customers outside Egypt, Paddle.com Market Ltd acts as merchant of record: Paddle takes the payment, handles sales tax and VAT, and is the seller shown on your invoice. Within Egypt, subscriptions are arranged with us directly.
Material you upload
You retain ownership of everything you upload: your dish photographs, your logo, your menu, your branch details and your own text.
By uploading material to Yafta, you confirm that:
- the photographs are yours, or you have permission from the person who took them;
- any person shown in a photograph has agreed to appear in your advertising;
- your menu, prices and offers are accurate and are yours to publish.
You grant us a licence to store and process that material for the purpose of operating the service and producing your posts. The licence ends when the material is removed from your account.
Logos, crests and people you ask us to feature
Yafta can produce a poster for an event you are hosting or announcing. When you request one you can attach photographs and describe the event, and the design may include marks and imagery belonging to whoever or whatever that event is about, such as a logo or an emblem.
Those marks belong to third parties. By asking us to use them you confirm that you are entitled to do so, and that their use does not imply a sponsorship, endorsement or partnership that does not exist. The same applies to any named individual you ask us to feature, including their photograph and their name.
You will indemnify us against any claim arising from a mark, an event or a person you asked us to depict, including reasonable legal costs. We may decline any request, and we will refuse one we consider likely to give rise to such a claim.
The images Yafta produces
We assign to you any rights we hold in an image Yafta generates for you. You may use it for your business without restriction.
Images are produced by AI models and are checked automatically against your own dish photograph before you see them. We provide the service with reasonable care and skill, but we do not warrant that any particular image is accurate, original or fit for a particular purpose. Your approval is the point at which you accept an image.
We retain all rights in Yafta itself, including the software, the website and the systems behind it. Nothing in these terms transfers any of those rights to you.
Acceptable use
You may not use Yafta to produce material that is unlawful, deceptive or offensive.
We may refuse a request, decline to generate particular content, or suspend an account that is used in breach of these terms or that exposes us to a legal claim. Where practicable we will give the reason first.
Liability
We provide the service with reasonable care and skill. We are not liable for what happens after you approve and publish an image, for the accuracy of information you supplied to us, or for losses that were not reasonably foreseeable.
Where the law permits us to limit our liability, it is limited to the total amount you paid us in the twelve months preceding the claim. Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or gross negligence.
Ending the agreement
You may stop using Yafta at any time by cancelling your subscription. Your account and your work remain available until you ask us to remove them.
We may end this agreement if you breach these terms. If we do, we will refund any amount you have paid for and not used.
General
Our handling of your personal data is described in our privacy policy.
These terms, together with the refund policy and the privacy policy, form the entire agreement between us in relation to Yafta and replace anything said or written before.
If any part of these terms is found to be unenforceable, the remainder continues to apply. If we do not enforce a term on one occasion, we do not give up the right to enforce it later.
You may not transfer your rights under these terms without our consent. We may transfer ours if the business is sold or reorganised, and your rights under these terms will not be reduced.
Changes and governing law
We may update these terms. The date at the top of this page records when they last changed, and we will notify you of any significant change before it takes effect.
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Cairo have exclusive jurisdiction. The English text is the governing version.
